1. Overview

Welcome to the “AI Magic Avatar” App (hereinafter referred to as “this App”), developed and operated by Tianjin Zhihuiyunke Information Technology Co., Ltd. This App is an AI-powered image generation tool that allows users to upload or capture photos and generate personalized avatars in various artistic styles using AI algorithms. Our goal is to provide a safe, fun, and efficient avatar creation experience.

2. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, and non-sublicensable personal license to install and use this App solely on authorized devices. You may not use this App for any commercial purposes, bulk generation, or illegal activities.

3. User Account and Login

This App offers a login feature to save your generation history and personalized settings. You must provide accurate and truthful information during registration and are fully responsible for the security of your account. If you suspect unauthorized access or unusual activity, please contact us immediately. We reserve the right to suspend or terminate accounts that violate this Agreement.

4. Content Upload and Usage

• You may upload local photos or capture images via your device’s camera for AI avatar generation. You warrant that the uploaded photos either depict yourself or that you have obtained proper authorization, and that they do not infringe upon any third party’s portrait rights, privacy rights, or intellectual property rights.
• You understand and agree that your uploaded photos will be temporarily processed by our AI model and stored on our servers for up to 24 hours after generation, allowing you to view and download them during this period.
• We will not use your original photos for any other purpose and will not share them with third parties, except where required by law or with your explicit consent.

5. AI-Generated Content

• Avatars generated by AI are algorithmic outputs and may exhibit stylistic variations or technical limitations. They do not represent real individuals and are intended solely for entertainment and creative reference.
• You are granted personal usage rights to the generated avatars, which may be used for non-commercial purposes such as social media profile pictures or personal display. If you intend to use them for commercial purposes (e.g., advertising, publishing), you should independently assess any associated legal risks.
• We make no warranties—express or implied—regarding the accuracy, artistic quality, or suitability of AI-generated content and shall not be liable for any disputes or damages arising from your use of such content.

6. Data Storage and Deletion

To allow you to review and download your creations, the system automatically retains your generation records and images for up to 24 hours. All related data will be automatically deleted from our servers thereafter.

7. Privacy and Data Security

We take user privacy seriously. This App processes your photo data only to the extent necessary and does not collect unrelated personal information. All data transmissions are encrypted, and our servers comply with industry-standard security practices.

8. Limitation of Liability

This App is provided “as is,” without any express or implied warranties. To the fullest extent permitted by law, Tianjin Zhihuiyunke Information Technology Co., Ltd. shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of or inability to use this App, including but not limited to data loss, AI generation inaccuracies, or third-party claims.

9. Agreement Amendments

We reserve the right to modify this User Agreement at any time. Revised terms will take effect upon posting within the App or on this page. Your continued use of the App constitutes acceptance of the updated terms.
